Our global experience in construction contract provides the basis for our services in Construction Dispute Resolution. We can assist in Adjudication, Arbitration, Commercial Negotiation and Settlement, Contractual Claims defence and assessment, Claim submissions, Mediation and Expert Witness instructions.
Whatever your contractual position, we can assist in the successful resolution of your dispute. Fees are based upon lump sum on a “stage by stage” or phased basis to suit your cashflow, and we can guide you every step of the way from crystallisation of your dispute through to successful resolution.
Andrew Mason is a practicing Arbiter and Adjudicator, and sits on the RICS in Scotland Chairman’s Panel of Adjudicators. In addition, he is a Law Society accredited Expert Witness, specialising in construction quantum and professional negligence. Derek Crawford, who heads the Corporate Team, has significant and wide-ranging contractual experience, and has successfully assisted in disputes for over fifteen years.
Our clients have included housebuilders and developers, main contractors, sub-contractors, suppliers and private clients. Subject to conflict of interest checks, we can act for any client with a financial interest in the resolution of an existing construction dispute.
A history of cases can be provided, but the company has been involved in over 60 adjudications and many arbitration processes, in addition to a constant history of cases resolved by commercial settlement.
We have been involved in Loss and Expense, Determination, Practical Completion, Interim Applications, Valuation and Quantum, Final Account evaluation, Variations, Provisional Sums, Defects, Damages, Bonds and all major areas of Construction and Civil Engineering works. Construction Insolvency...
Working for Insolvency Practitioners and Banks across the UK, we provide a full Insolvency Support Service, specialising in the negotiation and settlement of contract debtors, both current and aged. We also provide assistance in novation and assignment of contracts, and a full reporting service throughout each instruction. We have wide experience of Receivership, Liquidation, Personal Bankruptcy and continued trading instructions.
Our reports are billed on a lump sum basis and ongoing recovery of debt fees on a performance related percentage of the net sums collected. We also undertake a full and confidential Investigation Service pre-insolvency, and can provide full Asset Reports to immediate timescale requirements.
A full history of clients and cases can be provided, and our team has been active across the UK in construction insolvency cases since 1989.
Quantity Surveying...
We specialise in providing bespoke Quantity Surveying services to contractors, sub-contractors, developers, housebuilders and private clients depending on their workload. This can include meeting attendance, contract term negotiation, full contract surveying services, payments and applications, integration of commercial protection systems to ensure prompt payment, and full dispute recovery services to assist in cashflow.
Our work can be instructed on a “project by project” basis, and we often provide a “watching brief” to advise our clients on their day-to-day contractual requirements. Where required, we can organise and oversee Bills of Quantities, Condition Surveys and all major surveying requirements. Often, we allocate specific resources to particular clients to ensure a consistent and seamless service, and provide priority for immediate assistance as required by each client. Fees are normally based upon a monthly retainer, supplemented as required by lump sum agreements depending on required services.
A full list of services can be provided, although our proposals will normally be designed specifically for each client to suit their individual needs. Our team can work within the UK and internationally as required.
